Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by Terra Henderson, LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services.

2. Services

Terra Henderson, LLC provides subscription-based creative services.

Services are delivered on an ongoing basis in exchange for a recurring subscription fee. Subscriptions provide access to an ongoing queue of creative requests, delivered over time, subject to the limitations outlined in these Terms.

3. Requests, Turnaround & Scope

Clients submit requests through a designated Notion portal.

Each subscription includes:

• One active request worked on at a time
• Unlimited requests submitted over time
• Typical turnaround of 24–48 hours for short-form projects

Turnaround times are estimates only and are not guaranteed. Delivery speed may vary based on project complexity, revisions, and request volume.

Terra Henderson, LLC reserves the right to determine whether a request qualifies as a short-form project.

4. Subscription Billing & Renewals

Subscriptions are billed automatically on a recurring basis via Stripe.

• Subscriptions renew automatically unless canceled
• By subscribing, you authorize recurring charges
• Prices may change with advance notice

Failure to process payment may result in paused or terminated access to services.

5. Pausing, Canceling & Refunds

Clients may pause or cancel their subscription at any time.

• No refunds are provided under any circumstances
• After cancellation, access continues until the end of the current billing period
• Paused subscriptions retain unused time

Unused subscription time does not roll over beyond the active subscription period.

6. Intellectual Property

Upon full payment, clients own all final deliverables provided through the service.

Terra Henderson, LLC retains the right to display completed work for marketing, portfolio, and promotional purposes unless otherwise agreed in writing.

We do not create work that intentionally copies or infringes upon third-party intellectual property.

7. Client Responsibilities & Acceptable Use

Clients agree not to request or submit content that:

• Infringes on intellectual property rights
• Is unlawful, abusive, or deceptive
• Requires copying or closely replicating existing protected works

Terra Henderson, LLC reserves the right to refuse any request that violates these Terms.

8. Limitation of Liability

To the maximum extent permitted by law, Terra Henderson, LLC shall not be liable for any indirect, incidental, consequential, or special damages.

Total liability under any claim shall not exceed the amount paid by the client for services during the three (3) months immediately preceding the claim.

9. Termination

Terra Henderson, LLC reserves the right to suspend or terminate services for violations of these Terms or misuse of the service.

Termination does not entitle the client to a refund.

10. Arbitration & Governing Law

Any disputes arising from these Terms shall be resolved through binding arbitration in the state of Texas.

These Terms are governed by the laws of the State of Texas.

11. Changes to Terms

Terra Henderson, LLC may update these Terms at any time. Continued use of the services after changes constitutes acceptance of the revised Terms.
